Bradley Maybury and Michael James Maybury have been charged with robbery in company causing grievous bodily harm and recklessly causing grievous bodily harm in company following the alleged incident late last year.

The pair is alleged to have attacked a 20-year-old man, breaking his jaw and leaving him unconscious on Rouse St on December 14.

Michael Maybury stands accused of also stealing the man's wallet before witnesses arrived while his brother is facing one count of resisting arrest.

The victim, who was airlifted to hospital for emergency surgery, also suffered a fractured cheekbone and eye socket.

The duo have been in custody since they were arrested in December but solicitor Glen Kee told Armidale Local Court there was a lack of evidence in the case.

"There is no direct evidence of either accused striking the complainant in the area," he told the court.

The court was told a brief of evidence still had outstanding items.

"CCTV footage has in fact been served," Crown prosecutor Peter Woods told the court.

"Only the medical evidence we are chasing."

Medical records have been supplied but a statement is missing because the officer-in-charge of the case has not been able to speak with the ambulance officers who attended the scene.

"Are these ambulance officers in Tenterfield? It shouldn't be hard to find," Magistrate Karen Stafford said.

Mr Kee said the medical evidence had inferred a multiplicity of injuries therefore the expert statements from a doctor was needed.

"Medical evidence is quite central - the expert's report is keenly sought,” he said.

The case will head back to court in May.
