The Member for Northern Tablelands had his licence disqualified for nine months and was issued a $2000 fine in Glen Innes Local Court yesterday (July 15).
Mr Marshall was stopped by Glen Innes police for a random breath test on Friday, June 28, where he returned a mid-range alcohol reading.
He called himself a “bloody idiot” after he blew 0.112 - more than twice the legal limit.
"I reiterate that I made a huge mistake and deeply regret my actions. I drank and drove and was a bloody idiot.
"I would again like to sincerely apologise to the community, my friends and family for my actions," he said.
Magistrate Karen Stafford said she was aware Mr Marshall's actions had been publically chastised through recent media coverage and that, as part of his public standing, the offence had caused his to surrender two of his ministerial roles.
Mr Marshall stood down as the temporary speaker of the Legislative Council and deputy chair of the State and Regional Development Committee.
The court heard Mr Marshall's drink driving offence follows 17 counts of speeding.
He told the court it was a driving record he was not proud of.
Following his court appearance, Mr Marshall said he fully intends to publically accept the consequences of his actions and that the electorate will not suffer as a result.
"If any good comes from this situation, I hope it is a clear message to others – if you drink and drive you will get caught and suffer the consequences, as I am.
"I now intend to use my position as an MP to help educate others, particularly young people, about the dangers associated with drink driving and that it’s simply not acceptable," he said.
