24 year-old David Gallagher died on Sunday, June 12 from a suspected drug overdose, with reports now emerging he may have lay deceased for up to 12 hours before being discovered.
The Omega Festival was set to go ahead in Tabulam before Tenterfield Shire Council caught wind and filed a notice of motion to the Land and Environment Court of NSW the day before the event.
Organisers uprooted and took it to the remote property at Newton Boyd.
Clarence Valley Council, who handed down the maximum fine, says it will go after any owner who holds events of that nature, without approval.
“We will not allow people to flout rules that govern people's safety,” council general manager Scott Greensill said in a statement.
“If landowners think they can host illegal events like this without penalty they are completely misguided.”
Mr Greensill advised landowners who are approached by operators of such events to tell police.
“We make no apology for what some might consider a heavy-handed approach.
“A young person who attended this latest festival is dead and their family grieving,” Mr Greensil said.
A week since the festival wrapped up and organisers of the event are still yet to comment on the death or the running of the unsanctioned rave.
